Refund Policy for the Nearbyto.me Service (nearbyto.me)
1. Scope
1.1. This Refund Policy describes how refunds are handled for paid subscriptions to the Nearbyto.me Service (hereinafter — the "Service") provided by the operator of the Service (hereinafter — the "Company").
1.2. Payment for subscriptions is processed by Lava.top under its public offer. This Refund Policy describes the refund process from the User's perspective; the actual movement of funds is performed by Lava.top.
1.3. This Policy is read together with the Terms of Service (Article 7 — Withdrawal Right and Digital Content Waiver).
2. 14-Day Withdrawal Right
2.1. Pursuant to applicable consumer-protection law, the User may withdraw from the subscription within 14 calendar days from the date of purchase, unless the User has expressly waived the withdrawal right at the moment of first use of the Service.
2.2. Because subscriptions to the Service are digital content delivered immediately upon activation, the User is asked at registration to consent to the commencement of provision before the expiry of the withdrawal period and to acknowledge the loss of the right of withdrawal upon commencement. If the User has accepted this waiver and started using paid features, the withdrawal right is no longer available.
3. How to Request a Refund
3.1. The User may request a refund by either of the following channels:

Send a refund request to [email protected] from the email address associated with the subscription, including the date and approximate amount of the transaction. |
3.2. The Company will respond to refund requests submitted via email within 3 business days.
4. Processing
4.1. Approved refunds are processed by Lava.top to the original payment method.
4.2. Funds are returned within ten (10) business days, depending on the User's issuing bank.
5. Cases Not Eligible for Refund
5.1. Refunds are not issued in the following cases:
- the 14-day withdrawal period has expired and the User has used the paid features;
- the User has expressly waived the withdrawal right at the moment of first use (see §2.2);
- the User has violated the Terms of Service (Article 5) and the Account has been suspended or terminated as a result.
5.2. Refunds are at the Company's reasonable discretion in cases not covered by §5.1.
6. Disputes
6.1. Disputes regarding refund decisions should first be raised with the Company at [email protected]. If the matter is not resolved, the User may further escalate to Lava.top in accordance with Lava's public offer.
